How Offshore Claims Differ From Onshore Maritime Claims
Vessel and port-based maritime workers are protected by general maritime law frameworks like the Jones Act, the Longshore and Harbor Workers' Compensation Act (LHWCA), maintenance and cure, and unseaworthiness. Fixed platforms out in the Gulf add another layer through the Outer Continental Shelf Lands Act (OCSLA), which extends LHWCA coverage specifically to workers injured on those platforms, structures that aren't attached to a vessel or a dock at all.
Whether OCSLA/LHWCA or the Jones Act applies often comes down to a technical question: is the structure you were working on a "vessel"? Fixed platforms generally aren't, so injuries there typically fall under OCSLA. But many offshore drilling units, jack-up rigs, semi-submersibles, and drillships, can qualify as vessels, which may mean workers aboard them are legally "seamen" with Jones Act rights instead. This distinction can significantly change what you're entitled to recover, which makes getting the classification right essential.
