Common Types of Medical Malpractice
Medical malpractice can take many forms, but some of the most common cases we see involve:
- Surgical errors, including operating on the wrong site, leaving foreign objects inside a patient, or causing avoidable complications.
- Medication errors, such as prescribing the wrong drug, the wrong dose, or failing to catch a dangerous drug interaction.
- Misdiagnosis or delayed diagnosis, which can allow a treatable condition to progress untreated.
- Birth injuries, caused by improper prenatal monitoring or errors during labor and delivery.
- Anesthesia errors, including administering the wrong dosage or failing to monitor a patient properly.
- Defective medical products, such as devices or implants that fail or cause harm.
Texas's Strict Rules for Medical Malpractice Claims
Texas law makes medical malpractice cases considerably more complicated than a typical injury claim, largely due to the Texas Medical Liability Act (Chapter 74 of the Texas Civil Practice and Remedies Code).
A few of the most important rules:
- A 60-day pre-suit notice requirement. Under § 74.051, you generally must send written notice to each healthcare provider or institution you intend to sue at least 60 days before filing suit.
- A strict, and sometimes counterintuitive, statute of limitations. Under § 74.251, you generally have two years to file a claim from the date of the negligent act itself, or the completion of treatment, not from when you discovered the injury. This can catch people off guard if harm from an error doesn't become apparent right away.
- A 120-day expert report deadline. Under § 74.351, once a defendant files an answer, you generally have 120 days to serve a qualified medical expert's report establishing the standard of care, how it was breached, and how that breach caused your injury. Missing this deadline, or filing a deficient report, can get your case dismissed with prejudice, meaning you can't refile it.
